Create a Chaos Space Marines list and select Apocalypse and Imperial Armour from the Choose Rules/Change Roster Settings menu. It is under "Warmachines".

ok.. but it doesn't appear as an ally for Chaos Daemons which is what i need it for.. appears to be a glitch in the ally rule for that unit

That would be incorrect. It should appear under CSM when taken as allies to a CD roster. This is fixed for next release. Next time, please put it as an entry in the Tracker.

Given that it's a Warmachine it doesn't have an FOC, so it's unclear as to whether GW intended it to be "part" of a Chaos Daemons army. However, given that the Blight Drones and Blood Slaughterer are available for both Chaos Marines and Chaos Daemons in IA7/IAA2 I'd be inclined to have the Brass Scorpion available to Chaos Daemons too without needing take CSM as allies.

I've been treating that listing in IAA2 as gospel. It looks to me like the corrupted machines are CSM and the monstrosities are Daemons. I could be wrong though. At least the way I fixed it, you can add it in one list.

Is the Plague Hulk not a "corrupted machine"? IAA2 has FOC slots for both CSM and CD for that sheet ...

FW also include the Scorpion under the "Daemons and Beasts" section of their site as well as under "Vehicles": http://www.forgeworld.co.uk/Warhammer-4 ... ND__BEASTS

But so long as it's possible to it using the allies options it should be ok.

That's pretty much what I get from the shaded textbox in IAA2 in the Chaos section. That they are separated there is pretty much a concession to those who desire to play out of a single codex - but as long as they can be selected as allies it accomplishes the same thing for both purposes.
